Terms of Service

Welcome to Kafio. These Terms of Service (“Terms”) govern your access to and use of the Kafio restaurant management platform, including mobile applications, web applications, point-of-sale systems, kitchen display systems, inventory tools, analytics, and related services (collectively, the “Services”).
By using Kafio, you agree to these Terms.
1. About Kafio
Kafio provides restaurant management software designed to help restaurants manage billing, menus, inventory, staff operations, reporting, and related workflows.
Kafio is provided on a subscription basis.
2. Eligibility
You must:
- be at least 18 years old;
- have authority to bind the restaurant or business;
- provide accurate registration information.
3. Accounts
You are responsible for:
- maintaining account security;
- protecting passwords and devices;
- all activities performed under your account.
You must notify Kafio immediately of any unauthorized access.
4. Subscription & Billing
Kafio offers subscription plans billed monthly or annually. Subscriptions may include free trials, staff limits, feature restrictions, and usage-based limitations.
Failure to pay may result in suspension or termination of Services.
Third-party payment providers such as Stripe and Razorpay may process payments. Kafio does not store full payment card information.
5. Trial Periods
Kafio may provide free trial access. At the end of the trial period, paid subscriptions may begin automatically if authorized, or access may be restricted until payment is completed.
Kafio may modify or discontinue trial offers at any time.
6. Restaurant Data & Tax Responsibility
Restaurants are solely responsible for:
- tax compliance;
- GST/HST calculations;
- invoice accuracy;
- employee compliance;
- local regulatory obligations.
Kafio provides software tools only and does not provide accounting, tax, or legal advice.
7. Acceptable Use
You agree not to:
- reverse engineer the platform;
- interfere with platform security;
- upload malicious software;
- use the platform for unlawful purposes;
- resell access without authorization.
8. Third-Party Services
Kafio may integrate with third-party services including payment providers, delivery platforms, cloud hosting providers, and analytics providers. Kafio is not responsible for outages or failures caused by third-party services.
9. Service Availability
Kafio aims to provide reliable service but does not guarantee uninterrupted availability. Temporary outages, maintenance windows, internet failures, synchronization delays, and third-party disruptions may occur.
10. Limitation of Liability
To the maximum extent permitted by law, Kafio shall not be liable for:
- loss of profits;
- lost sales;
- data loss;
- tax penalties;
- indirect or consequential damages.
Kafio's total liability shall not exceed the amount paid by the customer during the previous 3 months.
11. Data Backup
Customers are responsible for maintaining backup copies of critical business data. While Kafio performs routine backups, restoration is not guaranteed.
12. Termination
Kafio may suspend or terminate accounts for non-payment, abuse, fraud, or violations of these Terms. Customers may cancel subscriptions at any time.
13. Intellectual Property
All Kafio software, branding, logos, interfaces, and related materials remain the exclusive property of Kafio. Customers retain ownership of their operational business data.
14. Changes to Services
Kafio may modify features, change pricing, discontinue services, or update subscription plans. Reasonable notice will be provided where applicable.
15. Governing Law
These Terms are governed by the laws applicable in the jurisdiction specified in the country-specific provisions below.

Country-Specific Terms
Canada
These Terms are governed by the laws of Ontario and applicable federal laws of Canada.
Customers in Canada are responsible for:
- GST/HST compliance;
- provincial tax compliance;
- labor compliance;
- payment terminal compliance.
Data may be processed outside Canada using international cloud infrastructure.
India
These Terms are governed by the laws of India.
Customers in India are responsible for:
- GST compliance;
- invoice generation compliance;
- local labor law obligations.
Payments may be processed using Razorpay or other approved providers.
